US Judge Mandates Release of Abrego Garcia from Immigration Custody
A court has ordered the prompt discharge of Kilmar Abrego Garcia from detention by ICE, concluding his ongoing detainment is without lawful basis.
"Since his release after erroneous imprisonment in El Salvador, he has been re-detained, again without lawful authority," the judge wrote in her ruling.
The situation originates in a mistaken deportation to El Salvador earlier this year, which the government later admitted was an error. After his repatriation to the United States to face alien smuggling charges, he was detained in immigration custody.
In her order, the court pointed out that the government does not have a current deportation order, which effectively blocks them from removing Mr. Abrego Garcia "at this time."

The legal challenge center on conflicting claims. While the former administration argues that Abrego Garcia is a member of the MS-13 gang, he categorically denies this allegation.
He has also entered a not guilty plea to the conspiracy charges, which are part of a separate trial in the state of Tennessee.
